🚀 The Big Story: The Ninth Circuit unblocked Perplexity's shopping agent
On August 5 the Ninth Circuit vacated the injunction Amazon won in March against Perplexity's Comet agent — the first federal appeals ruling on whether an AI agent counts as a "user."
The reasoning: the panel found that users, not Perplexity, accessed Amazon. Perplexity's servers received screenshots and sent back navigation directions; the agent "helps carry out the user's instructions."
The law: Amazon's Computer Fraud and Abuse Act claim — unauthorized access, traffic masked as ordinary browsing, logged-in accounts — didn't hold. The panel called Amazon "unlikely" to succeed on the merits.
The catch: the judges explicitly declined to write a broad rule for agentic AI. The case goes back to the lower court, and Amazon says it "respectfully disagree[s]" and is evaluating next steps.
Jason's take: Everyone is reading this as a Perplexity win. It's a retail problem. If an agent can buy on a customer's behalf, your product page stops persuading a human and starts feeding a retrieval index — and every dollar you spent on hero imagery, urgency banners and clever copy goes invisible. The bot-blocker was never the moat. Structured specs, real prices in plain text and honest availability data are, and you have about one quarter before that stops being an advantage and starts being table stakes.

Agents are coming to your pages whether or not you invited them. This is the cheapest version of getting ready.
Audit what an agent actually sees. Open your five highest-revenue pages in reader mode or view-source. Whatever's missing there is missing for the agent.
Get the facts out of images. Price, specs, availability and shipping belong in plain text. Agents can read screenshots; they read text far more reliably.
Fix your JSON-LD. Product, FAQ, Article. Ten minutes in a schema generator beats a month of copy edits.
Read your robots.txt. If you're blanket-blocking agent user-agents, make that a decision, not an inheritance from a 2023 template.
Run the real test. Ask your assistant of choice: "Buy this from [your URL] — walk me through it." Wherever it stalls is your bug list, already in priority order.
